New Civil Case Type Effective January 1, 2009

Effective January 1, 2009, the Minnesota Supreme Court adopted amendments to R. Civ. P. Form 23 adding a new civil case type, "consumer credit contract," that includes only cases in which the plaintiff is a corporation or organization (not an individual), the defendant is an individual, and the contract amount does not exceed $20,000.  Recent agreements between the Attorney General and health care providers require that certain cases in this category that had formerly been opened as default cases must be filed with the court as contract cases.  Distinguishing between these types of contract actions and other contract actions will help increase the accuracy of the case weights used to measure the courts workload.
