Requesting Subpoenas for Out of State Cases
A Minnesota subpoena can be issued for an out of state case for Depositions and/or productions of documents at a deposition. Attendance must be held in the county where the witness resides.
You must provide the following:
1) The subpoena fee
2) file number
3) case name
4) attorney or individual requesting the subpoena(s) with a corresponding phone number
5) notice of taking deposition and affidavit of service
A Minnesota subpoena can also be issued for Duces Tecum.
You must provide the following:
1)"Commission for Issuance of Out of State Subpoena Duces Tecum" signed by a judge from the originating state.
2) the subpoena fee
3) file number
4) case name
5) attorney or individual requesting the subpoena(s) with a corresponding phone number
The court administrator’s office will issue the subpoena signed, dated & sealed but otherwise blank to the party requesting it, who shall fill it in before service (Rule 45.01).
