Unlawful Detainer/Eviction Advisory Notice
A recent Court of Appeals decision establishes (or reconfirms) that corporations must be represented by attorneys in UNLAWFUL DETAINER/EVICTION proceedings. See Walnut Towers vs. Lori Schwan (filed September 16, 2008, #A07-1311), or click on:
REPRESENTATION OF CORPORATIONS IN DISTRICT COURT MEANS:
- That an attorney must sign the complaint on behalf of a Corporate plaintiff,
- That an attorney must appear at any hearing on behalf of a corporate plaintiff.
Note: There may be other circumstances that may require attorney involvement.
FAILURE TO HAVE ATTORNEY REPRESENTATION BY CORPORATIONS MAY RESULT IN THE CASE NOT BEING HEARD UNTIL ATTORNEY REPRESENTATION HAS BEEN SECURED OR THE CASE BEING DISMISSED.
