Collecting Rent Owed
An eviction action or unlawful detainer decides who has legal possession of rental property and whether or not the tenant must move. An unlawful detainer does not decide questions regarding back rent or damage deposits.
Landlords wanting to sue tenants for rent owed or damages to a rental unit may sue in Conciliation Court if the amount is $15,000.00 or below. If the amount claimed is above $15,000.00, the landlord must sue in district court.
Tenants wanting to sue a landlord for return of all or part of a damage deposit may sue in Conciliation Court if the amount is $15,000.00 or less or in district court if the amount is more.
