Judge Charles A. Porter, Jr. issued an Order from the motion hearing held on September 26, 2007. Please see below for an electronic copy.
According to the Code of Judicial Conduct, Canon 3 (A)(8): "A judge shall not, while a proceeding is pending or impending in any court, make any public comment that might reasonably be expected to affect its outcome or impair its fairness or make any nonpublic comment that might substantially interfere with a fair trial or hearing. The judge shall require similar abstention on the part of court personnel subject to the judge's discretion and control." Therefore, Judge Porter cannot comment on the hearing and will not be available for interviews and the media shall not contact the judge's chambers directly.
