Legal Separation

A legal separation is a determination made by a judge regarding the rights and responsibilities each spouse arising out of the marital relationship. It is different from a divorce in that a decree of legal separation does not end the marriage. A decree of legal separation may be granted when the court finds that one or both parties needs a legal separation.

We recommend that you get legal advice from an attorney if you want to file for legal separation. The courts do not publish the forms for legal separation, but you may find examples at a law library or legal publisher.
