SCHEDULING ORDER NO. 1

 

On July 12, 2001, Chief Justice Kathleen A. Blatz of the Minnesota Supreme Court appointed this special redistricting panel to “hear and decide all matters, including pretrial and trial motions, in connection with the panel’s ultimate disposition of the above-entitled action * * * .”  Zachman v. Kiffmeyer, 629 N.W.2d 98 (Minn. 2001) (Order of Chief Justice).  Pursuant to that Order, this panel has received various motions from parties and potential intervenors to this action.  This panel has reviewed those motions while keeping in mind that “reapportionment is primarily a matter for legislative consideration and determination.”  White v. Weiser, 412 U.S. 783, 794-95, 193 S. Ct. 2348, 2354 (1973), quoted in Zachman, 629 N.W.2d at 98.

NOW, THEREFORE, IT IS HEREBY ORDERED that motions to intervene pursuant to Rule 24 of the Minnesota Rules of Civil Procedure shall be made and served by 5:00 p.m. on Friday, September 14, 2001.  Persons wishing to intervene shall file one original document and nine copies with the Clerk of Appellate Courts.  All previously filed motion papers will be considered timely submissions.

IT IS FURTHER ORDERED that the parties and persons seeking leave to intervene may request oral argument on this matter.  If requested, oral argument will be heard on Wednesday, October 3, 2001, at 2:00 p.m. in Courtroom 300 of the Minnesota Judicial Center.  Arguments will be limited to 10 minutes apiece. 

This Order does not constitute a decision on any motion now before the panel.
